The world is in a constant state of change. This includes the fact that world trade, which is free in itself, is subject to manifold export controls that reflect the ever-changing political alliances and conflicts and must be observed by economic actors. We assist our clients in dealing with these export control law issues. In the context of international supply contracts and service agreements, many of our clients are confronted with the question of whether goods, services or financial resources may leave the domestic territory without further ado or whether this at least requires an authorization. Our legal advice includes the examination of the German Foreign Trade and Payments Ordinance, as well as legal norms of EU law applicable in Germany. The latter include the Dual-Use Regulation as well as the embargo regulations relating to individual countries or persons. In addition, due to the extraterritorial effects of U.S. export control law as understood by U.S. law, it is usually advisable to obtain legal advice on this as well. In this regard, we support our clients with our dense network of proven experts in this field.
In the field of export control law, we assist when clauses in contract negotiations raise export control law issues - these issues often arise in IT contracts with US contracting parties. However, we also safeguard our clients' interests when they aim to implement an export control law compliance system or wish to have it reviewed. The same applies to any voluntary disclosures that may be required if reports to BaFin have not been made in the case of foreign transfers or loans. In addition, we support our clients when they are confronted with specific transactions that raise export control or sanctions law issues and assist them when questions in this regard need to be clarified or, if necessary, fought out with the relevant government authorities in Germany and abroad.
